Application

This is an application for judicial review in respect of:

Judicial District of Medicine Hat
Court of Queen's Bench of Alberta
Action Number: 4808 009302
Reasons of Judgement of Justice Karen Horner

Leaving all remaining NOT yet split Matrimonial property and assets to the Defendant Rhonda Rose Achtem. The Applicant alleges that the Judgement lead to an unfair unreasonable 95 percent - 5 percent split in Ms. Achtem's favour based on separation date July 23, 2003. Leaving only 5 percent to the Plaintiff Edward Darren Achtem from a divorce with zero $0.00 exemptions.

Matrimonial Trial date: May 17, 2007.

The decision was communicated to the Applicant on: July 13, 2007.

The applicant makes application for:

1. Due to the length of the Applicant's Affidavit, a 10 day extension of time is required for the respondents to serve their affidavits upon the applicant. 40 days instead of the usual 30 days. This is to accommodate Respondents with ample time.

2. The Federal Court to; determine who may have sent the Honourable Court into disrepute. Determine if the Trial judge breached the powers of separation principal and the functus officio doctrine. Determine as to whether or NOT; if the Reasons for Judgement of Justice Karen Horner, is unlawful, criminal, and reasonable. Determine if it is just misconduct. Determine if she has caused the Court to become sent into disrepute. Determine as to whether or NOT; if her conduct was; accident or deliberate. Determine if the Defendant Rhonda Rose Achtem; if she has breached sections 6(1), 6(2), 28(1), and 28(2) of the Canada Evidence Act C-5. Determine if she is is responsible for the alleged offenses and bringing the Court into disrepute. Quash the alleged impugned decision.

3. Application of sections 24.(1) and 24.(2) of the Charter. For the Trial Judge's slip in drawing of Judgment. That lawlessly deprived the applicant of his alleged 50 percent share of matrimonial. From a divorce with $0.00 ZERO dollars exemptions. Due to the Judgment, and Orders stemming from it after. The applicant alleges that this is the main cause the lead him to having his Rights and Freedoms infringed upon. Pursuant to sections 1, 6.(1), 6.(1)(b), 7, 12, 14, 15.(1), 15.(2) of the Charter. Alleged lawlessness and said offences are the cause. Of the said infringement , infringing upon me, at this very moment and now. Ever since before Trial, under the colour of law must be stopped. Determine if it has, is, and has to be stopped. Or does Mr. Achtem continue to deserve this financial ravishment like he is a bug trapped in a jar judges have caused. Ms. Achtem enjoys the profits from her alleged fraud and the judicial negligence. Determine if this has to be stopped, enforce it. Craft an Order enforcing restitution.

4. First determine if the court is sent into disrepute. Then decide what to do next. Craft an Order, to deal with criminal proceedings as to whether they will be dealt with at Federal Court or it to be transferred to Provincial Court of Alberta. Craft an Order to deal with the Matrimonial Property issues, whether it be dealt with at Federal Court or transferred to a lower court. Craft an Order putting this in abeyance of the court first confirming percentages as to how much the defendant and the plaintiff received from matrimonial, subject to the information being provided.

5. Costs and damages.

The grounds for the application are:

1. The applicant is a human in a common law jurisdiction. He Alleges a breach of separation of powers principal and alleged breach of the functus officio doctrine by the Trial Judge, Justice Karen Horner. It is alleged she was taken away into malfeasance, as the accessory to the Defendant's alleged acts of Fraud and false pretences (after the fact). It is in the applicant's position that Justice Horner has purported to have committed offenses paragraphs 463(a), 362(1)(c), and 122 of the Criminal Code of Canada. By preventing Mr. Achtem any time to view documents at his request in the Witness Box. Justice Horner observed, admitted in the midst of Mr. Achtem's confusion from being an alleged intimidated Witness. By an alleged ambush of documents that she could not permit Ms. Achtem to adduce. Justice Horner

stated at Trial that Mr. Achtem did not have the exhibits. Justice Horner knew Mr. Achtem did not have documents presented at Trial. This maybe one of the many elements Justice Horner used to deliberately produce an alleged corrupted judgment. It shall be evidenced that she is an accessory that may have

brought the honourable court into disrepute. That ultimately lead to the alleged act of false pretenses. Which in turn ultimately gave way to Ms. Achtem's alleged act of FRAUD, Thusly bringing our honourable court into disrepute.

2. It is ALLEGED, on or before the 17th day, of May, 2007 A.D. Prior to, at, and after attending Trial. It is the applicant's position that Rhonda Rose Achtem has purported to have committed offences; paragraphs 380(a), and 362(1)(c) of the Criminal Code of Canada by preparing and producing documents that may have obstructed the course of justice, and thusly brought the honourable court into disrepute. It is alleged that Ms. Achtem has breached sections 6(1), 6(2), 28(1), and 28(2) of the Canada Evidence Act C-5. It is alleged that Rhonda Rose Achtem setup a Trial by Ambush as a deliberate premeditated attack on an individual who she know well and how to attack his disability. Ms. Achtem's alleged act of FRAUD and false pretence, thusly brought our honourable court into disrepute.

Notice of intent of Motions - paragraphs 3 to 6:

3. Kathleen Linton prepared an alleged false legal opinion for Legal Aid Alberta, January 21, 2008. It is the applicant's belief, this was a rigged setup directed by Legal Aid Alberta. None the less. It is the applicant's position that Kathleen Linton has purported to have committed offences paragraphs 122, 362(1)(c) of the Criminal Code of Canada. By deliberately preparing a false statement in writing. It is alleged she produced an incompetent legal opinion withOUT knowledge or researching. She did NOT use her ears when listening to me. I could hardly get a word in edge wise. She only talked and she knows everything and this is how it is going to be. She only has a mouth that speaks. No ears used for listening. Which lead her to the act of alleged false pretence. A Notice of Motion Application will be made soon.

4. It is the applicants position that Justice Carole Conrad has purported to have committed offences. Paragraphs 122, 131(1), and 362(1)(c) of the Criminal Code of Canada. By Preparing an alleged fictional Judgment. It is alleged along with 2 of her colleagues Justice Peter Martin, and Justice Alexander Park conspired together to make up their Judgment. Instead of making it based on facts and truth. They relied on some other unknown source Not conveyed by Me, Mr. Achtem, Therefore, the appeal panel produced a fictional Judgment by deliberately using fiction and writing it
down in their Memorandum of Judgment. A Reverse Onus Motion in a Notice of Motion Application will be made soon.

6. It is the applicants position that Justice Alexander Park has purported to have committed offences. Paragraphs 122, 131(1), and 362(1)(c) of the Criminal Code of Canada. By Preparing an alleged fictional Judgment. It is alleged that along with 2 of his colleagues Justice Carole Conrad, and Justice Peter Martin conspired together to make up their Judgment. Instead of making it based on facts and truth. They relied on some other unknown source Not conveyed by me, Mr. Achtem.  Therefore, The appeal panel produced a fictional Judgment by deliberately using fiction and writing it down in their Memorandum of Judgment. A Reverse Onus Motion in a Notice of Motion Application will be made soon.
